Terms of Service for Employers (Businesses)
Welcome to MicroJobs (https://microjobs.shop). This document constitutes a legally binding agreement between MyOwn Enterprise (“the Company”, “we,” “us,” or “our”), an ACRA-registered entity in Singapore, and the business entity or individual utilizing our platform as an employer or job poster (“Employer”, “you”, or “your”).
By creating an account, posting a micro-job, or utilizing any employer-facing services on our platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree to these terms, you must not use the platform.
1. Account Registration and Security
- To post job listings and engage job seekers, you must register for an Employer Account.
- You agree to provide true, accurate, current, and complete information during the registration process (such as your registered entity name, ACRA UEN, and billing details) and to update this information to keep it accurate.
- You are solely responsible for safeguarding your login credentials. You agree to notify customer support immediately at frederick@microjobs.shop if you suspect any unauthorized access to your account.
- We reserve the right to verify your business identity and status with ACRA at any time.
2. Identity Verification via Singpass Login
- To maintain a secure ecosystem and prevent corporate impersonation, our platform utilizes the Singpass Login API provided by GovTech Singapore to authenticate the identity of the person registering or managing the Employer Account.
- We only utilize the Singpass Login API for secure authentication purposes. We do not use the Myinfo API; therefore, no corporate profile or personal data is automatically populated. You must provide all business profile information manually.
3. Job Postings and Content Guidelines
- You are entirely responsible for the content of the micro-jobs you post. Your listings must not violate any applicable local laws, regulations, or guidelines in Singapore, including the Tripartite Guidelines on Fair Employment Practices (TAFEP).
- Prohibited Listings: You agree not to post any positions that involve, facilitate, or promote illegal activities, hazardous working conditions without proper regulatory safety protocols, adult entertainment, multi-level marketing (MLM) schemes, or deceptive business practices.
- We reserve the right, at our absolute discretion and without prior notice, to remove any job posting or suspend any Employer Account that we deem to be in breach of these guidelines, or that may bring reputational harm to the platform.
4. Relationship of Parties
- No Employment Relationship with the Company: MicroJobs acts strictly as an online matching platform to connect independent employers with job seekers. The Company is not an employment agency, employer, or joint employer of any job seeker or worker who applies for your listings.
- Direct Engagement: Any employment contract, independent contractor agreement, or micro-task arrangement formed through the platform is directly between you and the job seeker. You are solely responsible for managing the scope of work, workplace safety, performance evaluation, and compliance with the Employment Act of Singapore (where applicable).
5. Fees, Invoicing, and Payments
- Platform Fees: Registration on the platform may be subject to specific pricing tiers, listing fees, or commission-based matching fees as detailed on our website at the time of your listing.
- Invoicing: Invoices will be generated and issued electronically to your registered business email. All fees listed are in Singapore Dollars (SGD).
- Late Payments: If any due fees remain unpaid past the stated payment terms on your invoice, we reserve the right to suspend your ability to post new listings, hide your active postings, and restrict access to candidate applications until all outstanding balances are cleared.
6. Job Cancellations and Disputes
- Cancellation Policy: If you cancel an accepted micro-job or shift after a job seeker has been formally engaged, you may be subject to a cancellation fee to compensate the job seeker or platform, depending on the timing of the cancellation as outlined in our active platform policies.
- Worker Disputes: Should a dispute arise between you and a job seeker regarding job performance, completion, or payment for a task, you agree to attempt to resolve the issue directly with the worker in good faith. While we may choose to review platform communication logs to assist in structural dispute moderation, the Company holds no liability for a worker's performance or misconduct.
7. Intellectual Property
- All content, layout, design, software code, trademark logos, and structural components of (https://microjobs.shop) are the exclusive property of MyOwn Enterprise.
- By uploading job listings, company descriptions, or corporate logos to our platform, you grant the Company a worldwide, non-exclusive, royalty-free license to host, display, copy, and distribute that content on our platform to facilitate your recruitment goals.
8. Limitation of Liability and Indemnity
- The platform is provided on an "as-is" and "as-available" basis. We do not guarantee that your job postings will receive a specific volume of applicants or that candidates will meet your operational standards.
- To the maximum extent permitted by Singapore law, MyOwn Enterprise shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business opportunities, arising out of your use of or inability to use the platform.
- You agree to indemnify, defend, and hold harmless MyOwn Enterprise, its officers, and employees from and against any claims, damages, liabilities, costs, or losses arising out of your breach of these terms, your workplace conditions, or your employment/contractual relationship with any job seeker engaged through the platform.
9. Termination of Account
- You may close your Employer Account at any time by sending a formal termination request to customer support.
- We reserve the right to terminate or suspend your access to the platform immediately, without prior notice or liability, if you breach any provision of these Terms of Service or if we suspect fraudulent or malicious platform usage.
- Upon termination, any outstanding financial obligations or fees owed to us or to job seekers for completed tasks remain fully due and enforceable.
10. Governing Law and Dispute Resolution
- These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Singapore.
- Any dispute arising out of or in connection with these terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by the courts of Singapore.
